PRIVACY POLICY

This Privacy Policy is effective as of 1st July 2020.

With aspiration and goal to become a convenient home service platform, JobPro aims to improve people’s lives by reinventing and simplifying the connectivity between Service Professionals and Service Users. We, at Task Tap Technologies Sdn Bhd value your privacy as you use JobPro Apps. We respect your rights to privacy and we are committed to safeguarding the privacy of our users. When you use JobPro Apps, you are given the power to decide what personal information you may share with us.

This Privacy Policy Statement describes how we handle your personal information and set out the rights and obligations that both you and Task Tap or JobPro have in regards to your personal information. It also sets out the measures that we put in place with regards to Personal Data Protection. Defined terms used here shall bear the same meaning as defined in our Terms of Use, unless otherwise stated.

By downloading and / or using JobPro Apps, you consent to the collection and use of the Personal Data by Task Tap in the ways described herein (which may change from time to time) unless and until you inform us to the contrary here.

THIS POLICY IS CURRENT AS OF THE EFFECTIVE DATE SET FORTH ABOVE. TASK TAP MAY, IN ITS SOLE AND ABSOLUTE DISCRETION, CHANGE, AMEND AND / OR VARY THIS POLICY FROM TIME TO TIME. TASK TAP ENCOURAGES YOU TO REVIEW THIS POLICY REGULARLY FOR ANY CHANGES MADE. BY DOWNLOADING OR CONTINUING TO USE JOBPRO APPS AFTER ANY CHANGES TO THIS POLICY, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THIS POLICY INCLUDING ANY CHANGES, AMENDMENTS AND / OR VARIATIONS MADE TO IT.

1.    COLLECTION OF YOUR PERSONAL DATA

We collect personal information from Service Professionals offering their selected Services as well as from Service Users searching for those Service Professionals for hire. Every user of JobPro Apps, either a Service User or a Service Professional, is required to create an Account to be able to use the Apps. By creating an Account, a Service User or a Service Professional can gain access to use the JobPro Service. Account creation is individual on JobPro Apps, although a Service Professional Account may represent a group of Service Professionals under the same team, business group or company. We collect personal information from you when you register with or continue to use JobPro Apps and throughout the course of your usage of JobPro Service (collectively, “Personal Data”). The type of Personal Data that we collect from you varies based on your role (either as a Service User or a Service Professional), and thus your particular interaction with JobPro.

We collect your Personal Data when you register with or continue to use JobPro through the Apps. This may include but not limited to your phone number, full name, email address, city or region, selection of Service(s), business type, business name, bank account details, photos of your Malaysian identity card (MyKad) or photos of your professional documents, your brief business description or summary and your profile photo. JobPro Apps give you the option of providing a profile photo to be associated with your Account, which you may upload through your Account page. For Service Users using the app JobPro Home, your profile photo may be retrieved from your Facebook or Google account if you choose to log in to the app JobPro Home using your Facebook or Google Account.

Although most online, credit card and debit card payments in the Apps are processed by an integrated third-party payment gateway service provider SenangPay, we may also collect payment or transaction information such as credit card information from you. If we deem it necessary in our sole and absolute discretion, we may also ask for and collect supplemental information from third parties such as information about your credit from a credit bureau (to the extent permitted by law) or information to verify any identification details you provide during transactions in JobPro Apps.

For Service Users, we also collect Personal Data from your Submitted Content, including but not limited to the information or content you provide in your Service Request posting (such as your residential address and service time slots), the comments you post when making contact or communicating with the Service Professional you hire and the posting of feedback rating and review to the profile of the Service Professional whom you have hired at the end of your course in JobPro Service. We may also collect information available elsewhere, from the posting of any comment, testimony and review in connection with the Apps, JobPro Service, Services, Service Users and Service Professionals. To enable us to improve our existing JobPro Service, the facilities in the Apps and to create more features, we may collect and share with other users of JobPro and our customers the information about the way you use the Apps, which include but not limited to the transactions entered into the Apps, information in the profile of Service Professionals with received feedback ratings and reviews as well as comments communicated between Service Users and Service Professionals when the two make contact after hiring.

We strongly encourage you to use caution and discretion when making Service Request posts or any content submission as you are solely responsible for your Submitted Content. We DO NOT in any way control, take responsibility and assume liability for the disclosure or use of Personal Data which is voluntarily posted by you in any publicly accessible areas of the Apps JobPro Home and JobPro Team.

2.    COLLECTION OF PERSONAL DATA FROM FACEBOOK AND GOOGLE

For Service Users, you may log into the app JobPro Home using your Facebook or Google account. If you are using your Facebook account to log in, we will ask that you grant us permission to access and collect your Facebook basic information (this includes your name, profile picture, email address and any other information you have set to public on your Facebook account). If you allow us to have access to this information, then we will have access to this information even if you have chosen not to make that information public. We store the information that we receive from Facebook with other information that we collect from you or receive about you. In terms of information control, Facebook controls the information it collects from you. For information about how Facebook may use and disclose your information including any information you make public, please consult Facebook’s privacy policy.

If, as a Service User, you use your Google account to log in to the app JobPro Home, you will be required to provide and authenticate your phone number via one-time password (“OTP”). Every OTP is valid for only one log in session, in which the OTP will be sent to the mobile device associated to the phone number that you use to log in. We collect your Google basic information which includes your name, profile photo, phone number and email address. In terms of information control, Google controls the information it collects from you. For information about how Google may use and disclose your information including any information you make public, please consult Google’s privacy policy. We have no control over how any third-party site uses or discloses the Personal Data it collects about you.

3.    HOW YOUR PERSONAL DATA IS USED

We collect your Personal Data and aggregate information about the use of JobPro Apps, especially when you use JobPro Service and the Services to better understand your needs and to provide you with a better user experience. Specifically, we may use your Personal Data for the following purposes, including but not limited to:

1.    To provide the Services JobPro offers to you and to enable you to use JobPro Service. This includes registering you for the use of the Services in JobPro and to otherwise verifying your identity and authority, thus allowing you to use the Services in JobPro;

2.    For customer support and to respond to your inquiries. This is also to contact you via email, phone or where requested, by text message (SMS), Facebook Messenger or Whatsapp, to deliver information you have requested;

3.    For internal record-keeping purposes;

4.    To process billing and payment, including sharing with senangPay, a third-party payment gateway service provider integrated in JobPro Apps to enable us to receive online payments made in the Apps;

5.    To improve and maintain JobPro Apps and the Services, as well as for troubleshooting purposes where applicable;

6.    For Task Tap’s research purposes, including but not limited to the customization of JobPro Apps and the enhancement of JobPro Service according to your interests;

7.    To more effectively facilitate the promotion of Services to appropriate target audiences and for other research and analytical purposes. We may use your demographic information (e.g. frequently used Services, residential or commercial addresses and other various data);

8.    To resolve disputes, to protect ourselves and other users of JobPro and the Services as well as to enforce our Terms of Use;

9.    We may also compare Personal Data collected through JobPro Apps and Services to verify its accuracy with Personal Data collected from third parties;

10. We may combine aggregated data with the Personal Data we collect about you; and

11. For any purpose incidental, ancillary or in furtherance to the abovementioned purposes (collectively referred to as “Purposes”).

4.    MINOR’S PRIVACY

JobPro Apps are not intended for individuals under the age of eighteen (18) years (“Minors”). Only individuals who are eighteen years of age or older may use the Apps. If we discover that an individual under the age of eighteen (18) has provided us with Personal Data, such information will be deleted and the Account belonging to that said individual will be closed.

5.    SECURITY

We employ procedural and technological security measures, which are reasonably and practically designed to help protect your Personal Data from loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction. We ensure that confidentiality safeguards have been put in place to ensure your rights to Personal Data protection remains unaffected. We protect your Personal Data by: (i) restricting access to Personal Data; and (ii) maintaining and implementing measures to prevent unauthorized computer access, which includes using encryption, passwords. However, no security measures are perfect and no systems are 100% safe. Therefore, we do not promise and cannot guarantee, and thus you should not expect that your Personal Data or private communications will not be collected and used by others. You should take steps to protect against unauthorized access to your OTP, password, email address and mobile device by, among other things, choosing a robust password (where applicable) that nobody else knows or can easily guess and keeping your log-in (such as your OTP), password and mobile device private. Task Tap is not responsible for the unauthorized use of your information nor for any lost, stolen, compromised passwords or for any activity on your Account from unauthorized access.

6.    INFORMATION DISCLOSED TO PROTECT US AND OTHERS

We may disclose your Personal Data to prevent an emergency, protect or enforce our rights, enforce our Terms of Use and / or to protect the safety of users of JobPro Apps and the Services, protect or enforce the rights of a third-party or as required by law.

7.    INFORMATION DISCLOSED TO THIRD-PARTY SERVICE PROVIDERS AND BUSINESS PARTNERS

We may contract with various third parties for the provision and maintenance of JobPro Apps and our business operations. Task Tap may need to share your Personal Data and aggregated information (collectively, “information”) with these vendors and service agencies. For example, we may provide your information to a credit card processing company to process your payment. The vendors and service agencies will not receive any right to use your Personal Data beyond what is necessary to perform its obligations to provide their facilities to you. We may sometimes offer you surveys. If you complete a survey, we may share your information from the survey with the survey provider. If we offer a survey in conjunction with another entity, we also will disclose the results to that entity.

8.    INFORMATION DISCLOSED TO OTHER USERS OF JOBPRO

If you are a Service Professional, your Pro ID, the number of Jobs you have completed on JobPro, your earnings from Jobs completed on JobPro and some of the information that you submit to the app JobPro Team (other than your bank account details and payment information) will be visible to the Service Users of JobPro via the app JobPro Home. We intended that your earnings and the number of Jobs you have completed on JobPro are visible to the Service Users as this increases your chance of getting hired for Jobs. Information visible to Service Users also includes but not limited to your business name, profile photo, business description, business type, the Service(s) you provide and the feedback ratings and reviews posted to your profile by past Service Users who had received your Service and gave comments. This information is visible to Service Users when you respond to their Service Request by rendering your availability for hire and when they view your profile before they hire you. Feedback ratings and reviews posted to your profile may also be viewed by other Service Users, although they have not received any Service from you. When a Service User hires you for a Job, either you or the Service User may make contact by sending messages or comments. Communicated messages or comments will not be visible to other users of JobPro, apart from you and that specific Service User who hired you for the Job.

If you are a Service User, your Client ID, name, profile photo and the information you post when requesting a Service via the app JobPro Home will be visible to relevant Service Professionals in your region, provided that the Service(s) that they offer matches your Service Request, and that they are located in the same region or city as you. The information that you post when requesting a Service usually includes but not limited to the address of which you will receive your Service, preferred and alternative time slot and the request details such as your Service session, property type and attachments (collectively, “Request Details”). Should you receive responses from several Service Professionals rendering their availability for hire, you may hire a Service Professional of your choosing. After hiring, either you or the Service Professional you hire may make contact by sending messages or comments. Communicated messages or comments will not be visible to other users of JobPro, apart from you and that specific Service Professional whom you have hired for the Job. When the Job is complete, you are given the option to provide or post a feedback rating and review to the profile of the Service Professional you hired. The content that you post to the Service Professional’s profile will be visible to other Service Users when they view the profile.

9.    INFORMATION DISCLOSED TO LAW ENFORCEMENT OR GOVERNMENT OFFICIALS

We will disclose your information, including, without limitation, your full name, phone number, identity card (MyKad) number, email address, region, Account activity based on your Client or Pro ID and fraud complaints to law enforcement or other government officials if we are required to do so by law, regulation or other government authority or otherwise in cooperation with an investigation of a governmental authority.

10. IN THE EVENT OF A CHANGE OF CONTROL OR BANKRUPTCY

In the event that Task Tap undergoes a change in control, including, without limitation, a merger or sale of all or substantially all of Task Tap’s assets to which JobPro Apps relate to or other corporate reorganization in which Task Tap participates, and is thus merged with or acquired by a third-party entity (a “Successor”), Task Tap hereby reserves the right to transfer the information we have collected from the users of JobPro Apps and / or the Services in JobPro to such Successor.

In addition, in the event of Task Tap’s bankruptcy, reorganization, receivership, or assignment for the benefit of creditors, or the application or laws or equitable principles affecting creditors’ rights generally, Task Tap may not be able to control how your information is transferred, used, or treated and reserves the right to transfer the information we have collected from the users of JobPro Apps and / or the Services in JobPro to non-affiliated third parties in such event.

11. INFORMATION DISCLOSED AT YOUR REQUEST

We may share your Personal Data with other registered users of JobPro, to whom you explicitly ask us to send your information or if you explicitly consent to such disclosure upon receipt of a specific Service. For instance, when you contract for a specific Service with another registered user, Task Tap will send that registered user a notice that includes the Personal Data that you have chosen to allow Task Tap to reveal to users with whom you contract.

12. LINKS TO EXTERNAL PRODUCTS

JobPro Apps and the Website may contain links to other products or resources over which Task Tap does not have any control. Such links do not constitute an endorsement by Task Tap of those external products. You acknowledge that Task Tap is providing these links to you only as a convenience, and further agree that Task Tap is not responsible for the content of such external products. We are not responsible for the protection and privacy of any information which you provide while visiting such external products and such sites are not governed by this Policy. Your use of any external product is subject to the terms of use and privacy policy located on the linked to external product.

13. RETENTION STANDARD

Any Personal Data shall not be kept longer than is necessary for the fulfilment of the Purposes as set forth in Clause 3 above. Task Tap is committed to take all reasonable steps to ensure that all Personal Data is destroyed or permanently deleted when it is no longer required for the Purposes for which it was to be processed.

14. UPDATING, DELETING AND CORRECTING YOUR PERSONAL DATA

Task Tap is committed to take reasonable steps to ensure that the Personal Data is accurate, complete, not misleading and kept up to date by having regard to the Purposes for which the Personal Data was collected and further processed. Should you made aware of any inaccurate, incomplete and misleading Personal Data or where the Personal Data provided to us earlier have become incorrect and out of date, kindly contact us at help@jobpro.my. Typically, we will not manually alter your Personal Data because it is very difficult to verify your identity remotely. If in case you request to close your Account, we will do so and remove your Personal Data from view as soon as reasonably possible, based on your Account activity and in accordance with applicable law. We do retain information from closed Accounts in order to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations of any registered user, enforce our Terms of Use, and take any other actions otherwise permitted by law that we deem necessary in our sole and absolute discretion. You should understand, however, that once you publicly post a Service Request, feedback rating and review, comments or any other Submitted Content or information onto the Apps, you may not be able to change or remove it. Once we have deleted or removed your Account, you agree that Task Tap shall not be responsible for any Personal Data that was not included within your deleted and / or removed Account that remains on the Apps.

15. USING INFORMATION FROM JOBPRO

JobPro facilitates your sharing of Personal Data with others in order to negotiate, provide, and use the Services. If you agree to contract for a Service with another registered user typically a Service Professional, you may need to reveal your name, Client ID and Request Details to that Service Professional so that the Service can be performed. Please respect the privacy of others. You agree to use the information of other users solely for the following purposes: (i) JobPro transaction-related purposes; and (ii) using Services offered through JobPro.

16. ACCOUNT PROTECTION

For Service Professionals using the app JobPro Team, your password is the key to your Account. When creating your password, you should use unique numbers, letters, special characters, and combinations thereof. In addition, DO NOT disclose your password to anyone. If you do share your password or your Personal Data with others, you are solely responsible for all actions taken via your Account. If you lose control of your password, you may lose substantial control over your Personal Data and be subject to legally binding actions taken on your behalf. Thus, IF YOUR PASSWORD HAS BEEN COMPROMISED FOR ANY REASON, YOU MUST IMMEDIATELY NOTIFY TASK TAP TO CHANGE YOUR PASSWORD.
